It seems that the entire country has come to a halt during
this pandemic. While courts have, for the most part, postponed trials, and
hearings, and moved conferences to Zoom or the telephone, the statutes of
limitation have not been postponed.
Statutes of limitation are laws which set a maximum time in
which to file a legal proceeding. Depending on the type of claim, and the State,
they can be as short as one year from the event, or as long as 6 or more years.
Regardless, a claim cannot be filed, or if it is filed, it
will be dismissed on motion by the defendant.
There are many caveats and events which can extend the time,
or stop it from running, but a pandemic is not one of them.
The time to file your claim, and often your defense, is running.
Do not sit on your hands.
